Membership Agreement

SITE TERMS OF USE AND MEMBERSHIP AGREEMENT

Please read these Site Terms of Use and Membership Agreement ("Agreement") carefully before using our site. Users who use and shop on the buebchen.tr shopping site are deemed to have accepted the following terms.

Persons ("User") who use and purchase Bübchen branded products offered for sale by Saldos Ticaret Anonim Şirketi ("Saldos" or "Company") through the buebchen.tr website ("Site" or "Platform") owned by Transmed Gıda Sanayi ve Ticaret Anonim Şirketi are deemed to have read, understood, and agreed to be bound by this Agreement; to have the right, authority, and legal capacity to enter into a contract; and to be over 18 years of age.

This Agreement does not prejudice the status of Transmed ("ETAHS"), the operator of the Site, as an electronic commerce intermediary service provider; the seller of Bübchen branded products on the Site is Saldos, and ETAHS has the status of an electronic commerce intermediary service provider for the operation of the Site's technical infrastructure and the provision of intermediary services.

1. Responsibilities

• Saldos reserves the right to change the prices of Bübchen branded products and the services offered at any time.
• The member will benefit from the services subject to the Agreement, except for technical malfunctions.
• The User agrees not to reverse engineer or attempt to find or obtain the source code of the Site; otherwise, they will be responsible for any damages incurred and will be subject to legal and criminal proceedings.
• The User agrees not to produce or share content in their activities on the Site that is contrary to general morals and decency, illegal, harms the rights of third parties, is misleading, aggressive, obscene, pornographic, harms personal rights, infringes copyrights, or encourages illegal activities.
• The relationships between Site members or with third parties are their own responsibility.

2. Intellectual Property Rights

2.1. All registered or unregistered intellectual property rights such as title, business name, brand, patent, logo, design, information, and method on the Site belong to Transmed Gıda Sanayi ve Ticaret Anonim Şirketi, the owner of the Site, according to their nature, and to the registered rights holder of the Bübchen brand for rights related to the Bübchen brand, and are protected under national and international law. Visiting the Site or benefiting from the services does not grant any rights in these matters.

2.2. The information on the Site may not be reproduced, published, copied, presented, and/or transferred in any way. The whole or part of the Site may not be used on another website without permission.

3. Personal Data and Privacy

3.1. Saldos processes and protects the personal information submitted by users through the Site within the framework of the Personal Data Protection Law No. 6698 ("KVKK") and relevant legislation. Detailed information on the processing of personal data can be found in the Customer Illumination Text and KVKK Privacy Policy published on the Platform.

3.2. The User agrees that if they consent to receive commercial electronic messages for marketing, advertising, and campaign purposes, their personal data may be processed for this purpose; and that they can withdraw this consent at any time. Personal data is not processed for marketing purposes without explicit consent.

3.3. Personal data may be disclosed to authorized bodies only when formally requested by official authorities and when required by applicable legislation.

4. No Warranty

The services offered by Saldos are provided "as is" and "as available". Saldos does not guarantee that the services will be uninterrupted or error-free. To the maximum extent permitted by applicable law, no express or implied warranties are made regarding the services.

5. Registration and Security

The User must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be deemed to have been violated, and the account may be closed without notifying the User. The User is responsible for the password and account security on the Site. Saldos cannot be held responsible for security breaches or damage to hardware and devices.

6. Force Majeure

If the obligations arising from the contract become impossible to fulfill due to force majeure events beyond the control of the parties, such as natural disasters, fires, explosions, wars, epidemics, infrastructure and internet failures, power outages, the parties are not responsible for this. During this period, the rights and obligations of the parties arising from this Agreement are suspended.

7. Entirety of the Agreement

If one of the terms of this Agreement becomes partially or wholly invalid, the rest of the Agreement shall remain valid.

8. Amendments to the Agreement

Saldos may partially or wholly change the services offered on the Site and the terms of this Agreement at any time. Changes will be valid from the date they are published on the Site. It is the User's responsibility to follow the changes.

9. Notifications

All notifications regarding this Agreement will be made via Saldos' email address (contact@buebchen.tr) and the email address specified by the User in the membership form. The User accepts that the address specified during registration is a valid notification address and agrees to notify in writing within 5 (five) days if it changes.

10. Evidence Agreement

In any disputes that may arise between the parties regarding this Agreement, the books, records, and documents of the Parties, as well as computer and electronic records, will be accepted as evidence in accordance with HMK No. 6100, and the User agrees not to object to these records.

11. Resolution of Disputes

In the resolution of any disputes arising from the implementation or interpretation of this Agreement, the Consumer Arbitration Committees are authorized for Users with consumer status up to the value announced every December in accordance with the Law on Consumer Protection No. 6502; and Consumer Courts are authorized for disputes exceeding this value. For Users who do not have consumer status, Söke (Aydın) Courts and Enforcement Offices are authorized.
